Summary
States rarely file counterclaims in investment arbitration proceedings. Although the number of counterclaims has increased in recent years, this increase has been relatively modest. Against this backdrop, this thesis analyses whether there is an inherent obstacle to state counterclaims in ICSID arbitration proceedings. To this end, the author analyses the prerequisites of jurisdiction and close connection. She systematises the existing case law and literature according to her own criteria and develops standards for the assessment of jurisdiction and close connection. This thesis is thus both a scholarly analysis of the topic as well as a handbook on counterclaims in ICSID arbitration proceedings, filling a gap in the literature.
