Zusammenfassung

Politische Autorität ist in der Institution einer Rechtsordnung verwurzelt und damit mehr als bloße Macht. Als sozialen Konstrukten kann es Institutionen jedoch an Legitimität mangeln. Dieses Buch schlägt ein normativ-individualistisches und funktionales Verständnis von Legitimität vor. Politische Autorität kann demnach legitim sein, weil ihre Funktion, das friedliche Zusammenleben in einem Staat zu regeln, grundsätzlich allen Individuen nutzen kann. Damit ein Regime jedoch legitim ist, müssen Individuen auch durch liberale Grundrechte und Rechtsstaatlichkeit vor staatlichen Übergriffen geschützt sein. Auch wenn der funktionale Ansatz kein konkretes Staatsideal verfolgt, bietet er Leitlinien für die Gestaltung und Reform von Verfassungen.
