Zusammenfassung

Können mentale Einstellungen unterhalb der Schwelle sicheren Wissens der Tatbestandsverwirklichung eine strafrechtliche Verantwortlichkeit für völkerrechtliche Verbrechen begründen? Die Antwort auf diese Problematik ist dadurch bestimmt, ob beim Eingehen eines solchen Risikos die subjektiven Tatbestandsvoraussetzungen, die in einem Strafrechtssystem auf völkerrechtliche Verbrechen anwendbar sind, als erfüllt angesehen werden. Diese Untersuchung identifiziert die Lösungen, die in Deutschland, den USA, der Rechtsprechung der UN-ad-hoc-Tribunale und dem IStGH-Statut entwickelt worden sind.

Übergeordnetes Ziel der Analyse ist es, nicht nur einen umfassenden Überblick über die gegenwärtige Rechtslage zu liefern, sondern auch Reformvorschläge zu entwickeln, die das Zusammenspiel von nationalen und internationalen Gerichten bei der Verfolgung völkerrechtlicher Verbrechen berücksichtigen.
