Summary

Gute Gesetzgebung ist ein zentrales Anliegen jedes Staates und jeder Gesellschaft. Sie trägt bei zum Schutz der Individualrechte, schafft geeignete Rahmenbedingungen für wirtschaftliche Tätigkeiten und sichert das optimale Funktionieren der Behörden. Wie kann sichergestellt werden, dass die Gesetzgebung die gebotene Qualität aufweist? Der 7. Kongress der European Association of Legislation ging unter dem Titel "Der lernende Gesetzgeber" auf diese Frage ein. Die Kongressbeiträge zeigen aus praktischer und wissenschaftlicher Perspektive auf, welche Maßnahmen getroffen werden oder getroffen werden können, um die Qualität der Gesetzgebung zu verbessern. Sie gehen dabei auf die Situation in einzelnen Ländern ein und berücksichtigen auch Bestrebungen auf internationaler, insbesondere europäischer Ebene. Gute Gesetzgebung setzt namentlich voraus, dass der Gesetzgeber lernbereit und -lernfähig ist. Deshalb kommt dem Gesetzgebungsverfahren und der Ausbildung für die legistische Arbeit besondere Bedeutung zu. Die Beiträge machen deutlich, welche Fortschritte in diesem Bereich in den letzten Jahren erzielt worden sind und welche Lücken und Mängel nach wie vor bestehen. Sie liefern wichtige Grundlagen für Wissenschafter, Praktiker und Politiker, die sich für eine qualitativ gute Gesetzgebung einsetzen.
