Zusammenfassung

Schon seit „Boyd v. United States“ (1886) verheißt der 4. Verfassungszusatz US-Bürgern Schutz vor staatlichen Eingriffen in „the sanctity of a man’s home and the privacies of life“. Die vorliegende Arbeit untersucht Ursprünge und dogmatische Entwicklung des hieraus abgeleiteten „right to privacy“ und zeigt auf, warum der 4. Verfassungszusatz der staatlichen Überwachungstätigkeit (insbesondere) in der Öffentlichkeit dennoch bis heute kein stimmiges Schutzkonzept und keine wirksame Garantie der individuellen Privatsphäre entgegenhalten kann. Hierbei stützt sie sich auf eine gründliche Analyse des Normtexts und seiner Entstehungsgeschichte, behandelt verschiedene amerikanische Privatheitskonzepte und erörtert funktionale und vor allem politische Einflüsse auf die Rechtsprechung.
