Zusammenfassung

Welches Recht sollte auf die Haftung für Treibhausgasemissionen anwendbar sein? Die vorliegende Arbeit untersucht diese Frage und entwickelt Vorschläge für Kollisionsnormen. Sie geht von den naturwissenschaftlichen Hintergründen des Klimawandels aus und ordnet die grenzüberschreitende Haftung für Treibhausgasemissionen in den Rahmen internationaler Maßnahmen zum Klimaschutz ein. Sie analysiert die Interessen der Beteiligten und zahlreiche existierende IPR-Regelungen und diskutiert mögliche Anknüpfungspunkte mit ihren Vor- und Nachteilen und deren Zusammenwirken. Die Arbeit nimmt schließlich auch die Rolle von öffentlich-rechtlichen Genehmigungen und deren Wirkungen in grenzüberschreitenden Zivilklagen in den Blick.
