Zusammenfassung

Die Arbeit befasst sich mit dem Zusammenspiel von Innovationsanreizen und Wettbewerb. Die Europäische Kommission hat in ihrer Fusionskontrollentscheidung in Dow/DuPont weitreichende Auflagen auf das neu entwickelte Konzept des Innovationswettbewerbs gestützt. Das Konzept bezieht sich auf die allgemeine Innovationsfähigkeit der Parteien unabhängig von identifizierbaren Produkten oder konkreten Forschungs- und Entwicklungstätigkeiten. Die Autorin stellt das Konzept des Innovationswettbewerbs in einen weiteren Zusammenhang und prüft die Anwendbarkeit der zugrundeliegenden Erwägungen bei Artikel 101 und 102 AEUV.
