Zusammenfassung

Seit dem Investmentmodernisierungsgesetz (InvModG) können in Deutschland Hedgefonds als regulierte Investmentfonds aufgelegt werden. Die Arbeit stellt die Regelungen des InvG für Hedgefonds unter Berücksichtigung der Modifikationen durch das InvÄndG umfassend dar und unterzieht diese einer kritischen Analyse auf Grundlage eines Rechtsvergleichs zu den Regelungen für Hedgefonds in den USA und der Schweiz.

Ausgangspunkt des Rechtsvergleichs ist die Frage, wie das im Werk herausgearbeitete Spannungsverhältnis von Anleger- und Hedgefondsinteressen in den verschiedenen Rechtsordnungen aufgelöst wird. Auf Grundlage der im Rahmen des Rechtsvergleichs gefundenen Ergebnisse unterbreitet der Autor Änderungsvorschläge für Regelungen des InvG.
