Zusammenfassung

Methoden an Staatsgrenzen, die die Einreise von Migranten verhindern sollen, können von Pushbacks auf Hoher See, gewaltsamen Zurückweisungen an Landesgrenzen bis hin zu kompletten Grenzschließungen reichen. Inwieweit sind Zugangsrestriktionen an den Grenzen mit völker- und europarechtlichen Verpflichtungen vereinbar? Können besondere Ereignisse wie Massenzuströme oder eine Corona-Pandemie eine Ausnahme von diesen Verpflichtungen rechtfertigen? Die Untersuchung fokussiert sich zum einen auf die Situation an den EU-Außengrenzen und setzt sich auch mit dem kontroversen N.D. & N.T. v. Spain-Urteil des EGMR auseinander. Zum anderen werden die neuesten Vorkommnisse an der südlichen U.S.-amerikanischen Grenze beleuchtet.
