Vierzig Jahre nach seinem Inkrafttreten erlebt das System des Internationalen Übereinkommens zur Beilegung von Investitionsstreitigkeiten (ICSID) eine Phase bisher ungekannter Dynamik. Die enorme praktische Bedeutung des Investitionsschutzrechts wird zunehmend erkannt. Zugleich zwingen viele der anhängigen Verfahren ICSID-Schiedsgerichte, alte Probleme zu überdenken und zu neuen Herausforderungen Stellung zu nehmen. Die Beiträge zum vorliegenden Band analysieren die Entwicklung des internationalen Investitionsschutzrechts in den vergangenen 40 Jahren und untersuchen wichtige Herausforderungen, denen sich ICSID-Schiedsgerichte stellen müssen. Sie informieren den Leser etwa über
- die Rolle von NGOs im ICSID-Verfahren,
- die Debatte über ein Berufungsgericht für Investitionsfragen,
- das Verhältnis des Investitionsschutzrechts zum Recht der WTO und den internationalen Menschenrechten sowie
