Summary

Technologiepools wie der MPEG- oder DVD-Pool haben hohe wirtschaftliche Relevanz. Dessen ungeachtet war die Beurteilung von Technologiepools nach europäischem Kartellrecht bislang nur selten Gegenstand wissenschaftlicher Arbeiten. Auch auf eine grundlegende Entscheidung des Europäischen Gerichtshofes Erster Instanz kann der Rechtsanwender nicht zurückgreifen.

Dem starken Bedürfnis nach Orientierung in der kartellrechtlichen Selbsteinschätzung sollten die “Leitlinien zur Anwendung von Artikel 81 EG-Vertrag auf Technologietransfer-Vereinbarungen” nachkommen. Sie bilden den ersten zentralen Untersuchungsgegenstand der Arbeit. Auch das wohl weltweit einflussreichste Kartellrechtsregime, das US-amerikanische Kartellrecht, bedient sich Leitlinien zur Beurteilung von Technologiepools, den “Antitrust Guidelines for the Licensing of Intellectual Property”. Beide Leitlinien unterscheiden sich erheblich in Inhalt, Umfang und Detailliertheit.

Die rechtsvergleichende Arbeit erleichtert nicht nur die kartellrechtliche Bewertung eines Technologiepools zu erleichtern, sondern erleichtert auch die Leitlinien auf die zufriedenstellende Erfüllung ihrer orientierenden Funktion hin.
