Zusammenfassung

Immer wieder kommt es zu Konflikten und Spannungen zwischen dem staatlichen Regulierungsinteresse und dem Investitionsschutz, besonders bei Regulierungen im Bereich des Global Health Law. Welche Voraussetzungen aber muss ein Staat bei der Einführung gesundheitlicher Regulierung beachten, um nicht vor einem Investitionsschiedsgericht wegen Verletzung des Enteignungsverbotes und des Gebots der gerechten und billigen Behandlung haftbar gemacht zu werden? Die Untersuchung erarbeitet einen völkerrechtlichen Rahmen für den Erlass staatlicher Regulierungen, ausgehend von dem Schiedsspruch im Fall Philip Morris v. Uruguay. Dabei werden exemplarisch die Bereiche des Arbeitnehmerschutzes, der Umweltgesundheit, des Alkoholkonsums und der Lebensmittelgesundheit in den Blick genommen. Das Ergebnis dieser Analyse ist die Feststellung, dass die Einschränkungen staatlicher Spielräume bei Regelungen im öffentlichen Interesse weniger gravierend sind, als häufig angenommen wird.
