Zusammenfassung

Die EU setzt sich für strengere Vorschriften zur Verhütung von Umweltverschmutzungen durch Seeschiffe ein und erachtet internationale Bemühungen oft als unzureichend. Wenn sie in der Konsequenz eigene regionale Vorschriften erlässt und dabei von international vereinbarten Standards abweicht, fordert sie die Grenzen des Völkerrechts heraus. Drei Fallstudien, die akademische Analyse und praktische Perspektive vereinen, zeigen auf, wie das EU-Recht zur Verhütung von Umweltverschmutzungen durch Seeschiffe mit dem Völkerrecht kollidieren kann. Indem sie es vermeidet, dessen Vereinbarkeit und mögliche Konflikte mit dem Völkerrecht angemessen zu adressieren, gefährdet die EU ihre Glaubwürdigkeit als globale Akteurin und die Legitimität ihrer Gesetzgebung.
