Zusammenfassung
In diesem Buch wird die Frage untersucht, ob Staaten, deren Staatsangehörige wirtschaftliche Eigentümer oder Betreiber von Schiffen sind, die in einer ausländischen Ausschließlichen Wirtschaftszone (AWZ) illegalen Fischfang betreiben (Schiffseignerstaaten), verpflichtet sind, gegen diese Staatsangehörigen vorzugehen, wobei der Schwerpunkt auf der Situation in Westafrika liegt, einer der am stärksten betroffenen Regionen. Es wird ein Überblick über das internationale Rechtssystem gegeben, das für die Fischerei in einer AWZ gilt, und es werden verschiedene Quellen des internationalen Rechts sowie die staatliche Praxis, einschließlich der Vorschriften der Europäischen Union und der USA, betrachtet, die die Argumentation stützen, dass eine solche Verpflichtung besteht. Es werden Vorschläge gemacht, wie Schiffseigner, Küsten- und Flaggenstaaten dieser Verpflichtung nachkommen können.
