Zusammenfassung

Das Werk ist in zwei Teile gegliedert. Erstens beschreibt es den Status quo des militärischen Besatzungsrechts und den wirtschaftlichen Anreiz, den dieser Status quo für den Besatzer bietet. Zweitens wird anhand einer zeitgenössischen Auslegung gezeigt, wie Kapitel XI angewandt werden sollte und was dies für die wirtschaftlichen Rechte der Bewohner bedeuten würde. Es wird argumentiert, dass die Anwendung von Kapitel XI es für einen Besetzer wirtschaftlich unattraktiv machen würde, in einem fremden Gebiet zu bleiben, während sein Recht auf Selbstverteidigung intakt bliebe.
