Zusammenfassung

Der internationale Waffenhandel war bis zur Verabschiedung des Arms Trade Treatys (ATT) eine ungeregelte Materie, die aufgrund des hohen Waffenexports von Großmächten und angesichts zunehmender bewaffneter Konflikte auf der Welt in den letzten Jahren immer mehr Bedeutung erlangt hat. Die Untersuchung trägt zur Klärung von Problemen bei, die sich im Rahmen des Handels mit konventionellen Waffen und Dual-use-Gütern stellen. Dabei werden die wichtigsten Exportkontrollabkommen zunächst summarisch dargestellt. Danach wird das Verhältnis des ATT zu diesen Abkommen analysiert. Anschließend wird der ATT hinsichtlich seiner Regelungslücken ausführlich ausgelegt. Besonderes Augenmerk wird vor diesem Hintergrund dem Spannungsverhältnis zwischen Souveränität und Menschenrechten gewidmet. Abschließend wird der Zusammenhang zwischen dem ATT und der Dual-use-Güter-Kontrolle hergestellt. Dabei werden Lösungsvorschläge entwickelt, die sich mit der Kontrolle von Dual-use-Gütern beschäftigen.
