Zusammenfassung

Die 2. Auflage der Studie will dem Interesse gerecht werden, das Patienten unverändert den besonderen, von der Schulmedizin abweichenden Therapierichtungen entgegenbringen. Der eigenständige Ansatz der anthroposophischen Medizin beruht auf dem besonderen, von Rudolf Steiner entwickelten Menschenbild. Es wird in der 2. Auflage in der von der Medizinischen Sektion am Goetheanum Freie Hochschule für Geisteswissenschaften in Dornach 2011 verfassten „Deklaration zum Recht der anthroposophischen Medizin“ ausbuchstabiert und rechtlich kommentiert. Ziel des Bandes ist es, die für die anthroposophische Medizin maßgebliche Rechtslage zu beschreiben, zugleich aber ihren Anspruch auf Durchsetzung ihres besonderen Therapiekonzepts zu verdeutlichen.

Die anthroposophische Medizin geht davon aus, dass vier Wesensglieder zu den naturwissenschaftlichen Erkenntnissen von Aufbau und Funktion des menschlichen Körpers hinzutreten, nämlich der physische Leib, der Ätherleib, der Astralleib und die Ich-Organisation. Auf dieser Basis soll die Doppelfunktion von „Recht“ hervorgehoben werden. Damit wird der vorhandene Rechtsstand beschrieben, aber auch ein Rechtsanspruch, der nicht nur als Konsequenz aus dem geltenden Recht zu verstehen ist, sondern auch der Fixierung dessen dient, was die anthroposophische Medizin in ihrer Eigenständigkeit gesichert wissen will.

Der Autor, ein ausgewiesener Verfassungsrechtler, erörtert die Thematik der anthroposophischen Medizin durchgehend unter dem Pluralismus-Ansatz demokratischer Systeme. Für die anerkannten besonderen Therapierichtungen muss danach neben der Schulmedizin angemessener Platz sein.
