Summary

Unter Berücksichtigung der Dynamik der EU-Wettbewerbspolitik bietet die Autorin eine historische Perspektive des chinesischen Wettbewerbsrechts, der Durchsetzungspraktiken sowie zukünftiger Herausforderungen vor dem Hintergrund aktueller Wirtschaftsreformen und der damit einhergehenden Modernisierungsanstrengungen im Justizsystem. Die Leser werden mit den Prinzipien der chinesischen IP-Richtlinien vertraut gemacht. Neuere gerichtliche und verwaltungsrechtliche Grundsatzentscheidungen werden ebenfalls behandelt.

Die Autorin untersucht Themen an der Schnittstelle zwischen Chinas Wettbewerbsrecht und der geistigen Eigentumsrechte. Kohärente Ziele der beiden Rechtssysteme werden durch scheinbar gegensätzliche Mittel erreicht: Sicherung des freien Wettbewerbs für alle Marktteilnehmer gegenüber der Gewährung ausschließlicher Rechte an Eigentümer geistigen Eigentums. Für die chinesischen Wettbewerbsbehörden ist es äußerst schwierig, bei der Anwendung des Wettbewerbsrechts auf die Ausübung von Rechten des geistigen Eigentums ein optimales Gleichgewicht zu finden.
