Summary
From the preface: This book represents a revised and supplemented version of a chapter on Japanese tort law in »Basic questions of tort law from a comparative perspective«, edited by Helmut Koziol. Since there has until recently been no in-depth introduction to Japanese tort law in Western languages, and given both changes in the General Part of the law of obligations impacting tort law, and new regulation of the prescription of tort claims, this separate and expanded volume is intended to present a wider range of readers with broader insight into the field. Topics The law of damages within the system for protection of rights and legal interests The tasks of tort law Structure of the law of torts Contractual liability and delictual liability The basic requirements for delictual liability The elements of imputation Limitations of imputation The compensation of the damage Prescription of compensation claims
