Verfassungsgerichte spielen eine potentiell wichtige Rolle beim Übergang zu Demokratie und Rechtsstaat in Transformationsstaaten. Der Band untersucht rechtsvergleichend die Verfassungsgerichtsbarkeit in Südosteuropa und ihre Rolle im europäischen Rechtsraum.
Die neun Autoren analysieren das Verhältnis ausgewählter Verfassungsgerichte zur übrigen, nationalen Gerichtsbarkeit und zum Europäischen Gerichtshof für Menschenrechte. Wie sind die Interaktionen zwischen diesen Spruchkörpern geregelt? Ist ihre praktische Zusammenarbeit von Kooperation oder von Konflikten geprägt? Und welche Rolle spielen Verfassung und Europäische Menschenrechtskonvention im Ergebnis in der Rechtwirklichkeit der jeweiligen Staaten?
Der Vergleich stellt längere Transitionserfahrungen wie in Ungarn der bislang wenig beachteten, jüngeren Welle der Verfassungstransformation in Staaten wie Kosovo, Serbien und Albanien gegenüber. So werden Muster der Konstitutionalisierung und Europäisierung ebenso erkennbar wie allgemeinere Trends in der Entwicklung von Verfassungsgerichtsbarkeit und Rechtsstaat. Verfassungsgerichte erscheinen so zunehmend als Schnittstelle zwischen nationalen und internationalen Rechtsschichten und als Bausteine eines gesamteuropäischen Verfassungsgerichtsverbundes.
