Zusammenfassung

Um dem stetig wachsenden und sich weiter seewärts verlagernden Nutzungsdruck der Meere entgegenzutreten, ist es erforderliche Schutzmaßnahmen zu ergreifen.

Der Autor befasst sich speziell mit einem Schutzinstrument, das bislang verhältnismäßig häufig in küstennäheren Meereszonen eingeführt wurde: der Ausweisung von Meeresschutzgebieten (MPAs). Dabei liegt der Fokus konkret auf der Einführung dieser gebietsschützenden Managementinstrumente auf der Hohen See. Neben ihrer Entwicklung und der Frage nach deren Erforderlichkeit, wird ausführlich die derzeitige Rechtslage, insbesondere im Hinblick auf eine Verpflichtung zur Ausweisung, beleuchtet. Zudem findet eine Auseinandersetzung mit der Frage einer Drittstaatenbindung an die jeweiligen Schutzbestimmungen von Hohe See-MPAs statt. Schließlich enthält die Arbeit auch eine Darstellung der naturwissenschaftlichen Kriterien zur Identifizierung sog. „ecologically or biologically significant areas“, die als Grundlage für adäquate Standorte potenzieller MPAs dienen können.
