Zusammenfassung

Die Studie zielt darauf ab, die Lücken in der strafrechtlichen Verantwortlichkeit für den Schutz von Kulturgütern aufzuzeigen, was die Frage aufwirft, warum ein und dieselbe Straftat im Falle eines bewaffneten Konflikts als Verbrechen nach internationalem Recht gilt, aber nicht, wenn kein solcher Konflikt vorliegt. Die Zerstörung der Buddhas von Bamiyan im Jahr 2001 war einer der ersten Hinweise darauf, dass Angriffe auf Kulturgüter nicht immer durch das Recht des bewaffneten Konflikts geregelt werden. Dieser Vorfall hat gezeigt, dass es auf internationaler Ebene eine Lücke gibt, wenn es um Straftaten gegen Kulturgüter in Friedenszeiten geht.
