Der Eckpfeiler des europäischen Zivilverfahrensrechts
Die Brüssel I-Verordnung (EG) des Rates Nr. 44/2001 über die gerichtliche Zuständigkeit und die Anerkennung sowie Vollstreckung von Entscheidungen in Zivil- und Handelssachen vom 22.12.2001 bildet den Eckpfeiler des europäischen Zivilverfahrensrechts. Die Verordnung ist in allen Mitgliedsstaaten unmittelbar anwendbar; sie steuert als allgemeines Referenzinstrument die grenzüberschreitenden Zivilprozesse in der Europäischen Union.
Das neue Werk
der bekannten deutschen Rechtslehrer Hess, Pfeiffer und Schlosser liefert eine umfassende Analyse der Anwendungspraxis der Verordnung in den Mitgliedsstaaten auf der Grundlage von Interviews, statistischen Erhebungen und rechtstatsächlicher Forschung in den Akten der nationalen Gerichte. Die Berichterstatter empfehlen einige Verbesserungen, insbesondere im Hinblick auf die Verordnung als Referenzinstrument des europäischen Zivilprozessrechts.
