Summary

Mit der Publikation der Broschüre Die Lage der europäischen Rechtswissenschaft wollte Schmitt sich als Autor nach 1945 gleichsam neu erfinden und sein einige Monate später erschienenes Spätwerk Der Nomos der Erde ankündigen. Das folgende Buch sucht einen produktiven Umgang mit diesem hermeneutisch voraussetzungsvollen, strategischen Text, indem es die Fassung von 1950 neu übersetzt, historisch-philologisch kommentiert und in einem dritten Schritt dann plurale Auseinandersetzungen, Adaptionen und Transformationen anbietet. Es verlässt also die gängige Form eines Kommentars, indem es zwischen Explikation und Transformation deutlich trennt und eine Art freie Übersetzung ins 21. Jahrhundert vorschlägt.Mit Beiträgen vonAdeel Hussain, Reinhard Mehring, Michael Stolleis, Christian Tomuschat, Armin von Bogdandy und Lewald Water.
