Zusammenfassung

Das Hauptziel des Buches ist es, die rechtlichen Aspekte der funktechnischen Störungen zu untersuchen, mit denen die Operatoren der Satellitenkommunikationen derzeit immer öfters konfrontiert sind – die sich verschlechternde Qualität der Signale, die sowohl gezielt (sog. jamming) oder unabsichtlich auftreten kann.

Es beantwortet folgende Fragen: Ist das rechtliche Regime der Internationalen Fernmeldeunion (ITU) ausreichend ausgestattet, um diese negativen Phänomene vorzubeugen und bekämpfen? Welche sind die rechtlichen Folgen der Verletzung seiner Regelungen? Welche ist die Rolle der zuständigen nationalen Institutionen? Und schließlich, ist die Tendenz zur Integration des Spektrum-Managements auf der Ebene der Europäischen Union der effizienteste Weg, um die Situation zu verbessern?

Die prominenten internationalen Autoren, Spezialisten des Telekommunikations-, Weltraums- und Europarechts analysieren diese Fragen auf der Grundlage von Fällen, mit denen sich die ITU befasst hat, und suchen nach neuen Wegen der Bekämpfung dieser Phänomene.

Die Herausgeberin, Prof. Mahulena Hofmann, Inhaberin des SES Lehrstuhls für Satellitenkommunikations- und Medienrecht in Luxembourg, ist eine international anerkannte Expertin auf diesem Bereich.
