Zusammenfassung

Die Studie analysiert die Stringenz von EU-Umweltregulierungen. Entgegen der Vorstellung eines bloßen handelsökonomischen „trading up“ von Standards ermöglicht die entwickelte Theorie des Umweltföderalismus die Betrachtung politischer Mechanismen und Effekte der Regulierung. Die Untersuchung europäischer und nationaler Entscheidungen in der EU-Abgasgesetzgebung zeigt, dass auch in extremen Fällen der Sozialregulierung, bei denen die betroffene Industrie ökonomisch und politisch machtvoll ist, strenge Vorschriften möglich sind.

Die Verteilung der Kosten über Industrie und EU-Mitgliedstaaten erweist sich als zentraler Mechanismus, der strengere und schwächere Regulierungen hervorbringt. In der Abgasgesetzgebung zeigen sich systematisch Unterschiede in der Regulierung von CO2 und Luftschadstoffen. Die Einführung von Dieselpartikelfiltern erfolgte relativ spät als Resultat einer „baptist-bootlegger“-Koalition von Umweltverbänden und Teilen der europäischen Automobilindustrie.
