Zusammenfassung

Dieses Werk nimmt erstmals eine umfassende historische Rekonstruktion des Luftkriegsrechts vor. Die normen- und diskursgeschichtliche Untersuchung führt dabei die untergeordnete Rolle vor Augen, die das Humanitäre Völkerrecht in der Einhegung der Luftkriegsführung eingenommen hat. In historisch-chronologischer Weise zeichnet Enno Mensching hierzu die theoretische Entwicklung und praktische Beachtung der luftkriegsrelevanten Rechtsnormen seit den Anfängen der Luftfahrt nach. Besonderes Augenmerk liegt auf der kritischen Aufarbeitung des völkerrechtlichen Diskurses und der Identifikation der diskursiven Legitimationsstrategien, die bis heute zur Durchsetzung militärischer Interessen auf Kosten des humanitären Schutzes reproduziert werden.
