Zusammenfassung

Albanien pflegt gewohnheitsrechtliche Traditionen, die so alt sind wie das römische Recht und in einem Buch namens "Kanun" kodifiziert sind. In diesem Gesetzbuch gibt es auch ein Kapitel über "Blutrache". Die im "Kanun" kodifizierte Gesetzgebung, insbesondere die Blutfehde, steht weiterhin im Konflikt mit dem staatlichen Strafsystem. Nach Weber und Durkheim wurde die Blutrache als Regulierungsinstrument zur Aufrechterhaltung der öffentlichen Ordnung in Gesellschaften betrachtet, in denen der Staat und die staatlichen Institutionen noch nicht existierten. Wenn Gesellschaften zur "organischen Solidarität" übergehen, wird die Blutfehde üblicherweise eingeschränkt oder ganz aufgehoben. Daraus ergibt sich das Dilemma, auf das diese Monographie eine Antwort geben will: warum in einem modernen Staat die Institution der Blutrache immer noch verfolgt wird, fortbesteht und mit dem staatlichen Rechtssystem gleichgesetzt wird.
