In weiten Teilen der Welt und über die verschiedenen Gebiete hinweg ist das Recht zu einem Produkt geworden. Einzelpersonen und Unternehmen suchen grenzüberschreitend nach der für sie attraktivsten Rechtsordnung. Gleichzeitig bewerben verschiedene Länder im Wettbewerb mit anderen ihr Recht als Ware höchster Qualität (Beispiel: „Law made in Germany“). Die Analyse dieser Entwicklung und die Erarbeitung von Vorschlägen auf dem Gebiet des Vertragsrechts und der Streitbeilegung waren Gegenstand einer Tagung, die im Oktober 2011 in München stattfand. Die Teilnehmer waren führende Wissenschaftler aus Europa und den USA. Dieses Werk enthält die Beiträge zu dieser Konferenz.
