Zusammenfassung
Grenzüberschreitende Insolvenzverfahren zwischen EU-Mitgliedstaaten und Drittstaaten sind in der Insolvenzpraxis allgegenwärtig, aber kaum geregelt. Sollte die EU dafür einen gemeinsamen Regelungsrahmen schaffen? Welche Rolle könnte UNCITRAL dabei zukommen? Der vorliegende Band liefert strukturierte Einblicke in klassische Themen des Internationalen Insolvenzrechts wie Universalität und Territorialität, Anerkennung ausländischer Verfahren, nationale Verfahren mit Auslandsbezug etc., behandelt aber darüber hinaus auch Zukunftsthemen wie ADR und neue Technologien im Insolvenzrecht. Das Buch bündelt die Erkenntnisse von 32 weltweit führenden Experten aus 19 EU- und Nicht-EU-Ländern und entwickelt Überlegungen für legislative Schritte. Dieser Titel erscheint auch Open Access.
