Zusammenfassung

Das staatliche Beihilfenrecht gehört zu den wichtigsten und zentralsten Gebieten des Rechts der Europäischen Union. Die Wettbewerbsfähigkeit von Unternehmen würde grundsätzlich durch staatliche Beihilfen verzerrt und die Vorteile des Binnenmarktes gefährdet.

Der Kommentar behandelt artikelweise die dem Beihilferecht zugrundeliegenden Grundsätze, das Verfahren sowie die Umsetzung des Beihilferechts in den Mitgliedsstaaten gem. Art. 107 bis 109 AEUV. Zentraler Gegenstand sind des Weiteren die Gruppenfreistellungsverordnung (VO Nr. 800/2008) und die durch die Ratsverordnung (EG) Nr. 659/1999 niedergelegten Bestimmungen zur Anwendung des Art. 93 EUV. Schließlich geht dieser Kommentar auch detailliert auf das Beihilferecht in einzelnen Sektoren ein, wie Telekommunikation, Postdienstleistungen, Radio und Fernsehen, Energie/Kohle, Bankwesen, Eisenbahn, Straßentransport, Schifffahrt, Luftverkehr/Flughäfen, Automobilindustrie, Werften, Stahl, Immobilien, Landwirtschaft, Fischerei, Kultur/Tourismus/Sport und Gesundheit.
