Zusammenfassung

Der Autor untersucht die so genannten Leitentscheidungen des Obersten Volksgerichts der Volksrepublik China. Die Leitentscheidungen werden vom Obersten Volksgericht aus den in Kraft getretenen Urteilen ausgewählt und veröffentlicht. Abgesehen von den juristischen Auslegungen sind diese Entscheidungen ein weiteres Instrument des Obersten Volksgerichts, mit dem es versucht, die Entscheidungen und Urteile der unteren Gerichte zu beeinflussen, aber die Ergebnisse sind nicht so eindeutig, wie sie sein könnten. Der Autor untersucht aus verschiedenen Perspektiven, weshalb die Leitentscheidungen nicht die vom Obersten Volksgericht erhoffte Wirkung entfaltet haben.
