Zusammenfassung

Altersgrenzen sind derzeit auf nationaler, europäischer wie internationaler Ebene höchst umstritten. Die Notwendigkeit einer kritischen Analyse ergibt sich aus zwei Gründen: erstens aus sozio-politischer Perspektive, d.h. angesichts eines wachsenden Drucks auf die finanzielle Stabilität der Pensionssysteme bedingt durch den demografischen Wandel. Zweitens aus rechtlicher Perspektive, da der Schutz vor Altersdiskriminierung, insbesondere durch die Richtlinie 2000/78/EG wesentlich gestärkt wurde. Vor diesem Hintergrund wird die Vereinbarkeit ausgewählter Altersgrenzen im norwegischen und deutschen Recht mit dem in der Richtlinie verankerten Altersdiskriminierungsverbot untersucht. Ferner wird ein interdisziplinärer Ansatz verfolgt. Empirische Erkenntnisse und Theorien zu Alterungsprozessen sowie Arbeitsmarktdaten werden in den Blick genommen, um die Integrität der Argumente zu testen, die typischerweise bei der Rechtfertigung von Altersgrenzen angeführt werden. Schließlich werden flexible Lösungen als Alternative zu Altersgrenzen für den Übergang in die Rente diskutiert.
