Nichtstaatliche Gewaltakteure und das Humanitäre Völkerrecht

Zusammenfassung

In innerstaatlichen Konflikten sind Zivilisten zwar prinzipiell durch Bestimmungen des humanitären Völkerrechts geschützt. In der Praxis ist ein solcher Schutz aber nur unzureichend gewährleistet – gerade auch, weil zunehmend nichtstaatliche Akteure am Konfliktgeschehen teilnehmen. Wie aber nichtstaatliche Gewaltakteure von der Notwendigkeit überzeugt werden können, humanitäre Standards einzuhalten, war lange Zeit unklar.

Anhand von zwei detaillierten Fallstudien, der LTTE in Sri Lanka und der SPLM/A im Südsudan, zeigt diese Studie, dass bewaffnete Akteure dann bereit sind, sich zu humanitären Normen (wie dem Verbot von Landminen) zu bekennen, wenn sie sich davon Anerkennung durch die transnationale Gemeinschaft versprechen. Diese Ergebnisse widersprechen der weit verbreiteten Annahme, nur eine Kriminalisierung nichtstaatlicher Gewaltakteure helfe im Umgang mit diesen. Die Studie stützt sich dabei auf 58 Experteninterviews, die u.a. vor Ort mit ehemaligen Rebellen durchgeführt wurden.
