Zusammenfassung
Der umfassende Band zeigt, dass die heute an ein modernes Familien- und Kindschaftsrecht gestellten Anforderungen in entwickelten Industriegesellschaften nur mehr teilweise vom jeweiligen kulturellen Hintergrund geprägt sind, wie auch die damit verbundenen Fragen in Hinblick auf die seitens der Allgemeinheit zu schaffenden Rahmenbedingungen. Gerade in Zeiten des rapiden gesellschaftlichen Wandels und der wirtschaftlichen Krise erlangt die Frage, welche Risiken als private und/oder soziale anzusehen sind, besondere Bedeutung. Themen und Fragestellungen Beiträge aus zahlreichen europäischen Staaten sowie aus China, Japan, Südkorea, Südafrika, Nord- und Südamerika und Israel zeigen die ganze Brandbreite unterschiedlicher Lösungsansätze für die brennende Fragen der Zeit: Ehen mit Migrationshintergrund, Patchwork-Familien, Unterhaltsleistung, Vermögensaufteilung, Wahl des Wohnsitzes und die damit verbundenen finanziellen Aspekte des Transfers von Leistungen, Waren und Geld unter den Familienmitgliedern, von Dritten an Familien und von diesen an Dritte. Die mit solchen Transfors verbundenen und mitunter erheblichen Transaktionskosten werden beleuchtet und deren Sinnhaftigkeit in einer modernen Gesellschaft hinterfragt. Viele der Beiträge zeigen dabei auf, dass das von Rechtsvorschriften oder privatrechtlichen Verträgen angestrebte Ziel möglicherweise nicht erreicht wird.
