Zusammenfassung

Die Erkenntnis, dass es zur tatsächlichen Konstruktion einer Demokratie und der Wahrung des Rechtsstaats eines Schutzmechanismus bedarf, begründet die Notwendigkeit des Instituts der Verfassungsgerichtsbarkeit und führte zu dessen weltweiter Verbreitung.

Die Arbeit untersucht die verfassungsrechtliche Entwicklung in Burkina Faso und analysiert insbesondere anhand der Rechtsprechungspraxis, den Beitrag des Verfassungsgerichts zum Demokratisierungsprozess und zu Rechtsstaatlichkeit. Sie erschließt mit dem frankophonen Westafrika eine Region, die über die französischsprachige Verfassungsvergleichung hinaus bisher kaum berücksichtigt und wenig erforscht wurde. Zusätzliche Aktualität hat das Thema durch die Verfassungsentwicklung nach Protesten gegen eine erneute Amtszeit des Staatspräsidenten und dessen Sturz im Herbst 2014 erlangt. Die Untersuchung Burkina Fasos kann daher auch als ein Erkenntnisgewinn über einen laufenden Demokratisierungsprozesses betrachtet werden.
