Die Verordnung (EG) Nr. 207/2009 des Rates vom 26. Februar 2009 über die Gemeinschaftsmarke dient dem reibungslosen Funktionieren des Binnenmarktes, der mit einem einzelstaatlichen Markt vergleichbare Bedingungen bieten soll. Um einen solchen Markt zu verwirklichen und seine Einheit zu stärken, müssen auch rechtliche Bedingungen geschaffen werden, die es den Unternehmen ermöglichen, ihre Tätigkeiten in den Bereichen der Herstellung und der Verteilung von Waren und des Dienstleistungsverkehrs an die Dimensionen eines gemeinsamen Marktes anzupassen.
