Zusammenfassung

Ergänzende Schutzzertifikate (ESZ)verkörpern einen enormen wirtschaftlichen Wert: Sie verlängern die Schutzdauer bei Patenten auf Wirkstoffe von Arzneimitteln um maximal fünf Jahre, häufig zu einem Zeitpunkt, zu dem das jeweilige Arzneimittel auf dem Markt bestens eingeführt ist und maximalen Profit abwirft. Die damit verbunden Rechtsfragen sind höchst umstritten und Gegenstand zahlreicher Entscheidungen des Europäischen Gerichtshofs. Das Handbuch von Stief/Bühlerbehandelt ausführlich die den ESZ zugrunde liegenden EU-Verordnungen sowie die jeweiligen europäischen oder nationalen Grundpatente, aus denen sich die ESZ ableiten. Schritt für Schritt werden insbesonderedie speziellen Voraussetzungen, unter denen eine derartige verlängerte Schutzdauer gewährt wird,die Reichweite dieses Schutzes sowie dessenRechtsdurchsetzunganhand prägender Entscheidungen des EuGH erklärt.Besonders praxisnahnehmen die Autoren des neuen Handbuchs vor allem die deutsche Rechtsprechung zu den ESZ, die regelmäßig Grundlage von Entscheidungen des EuGH ist, in Bezug.
