In March 2021, the CJEU confirmed the dismissal of the People’s Climate Case issued by the General Court on the grounds that the private applicants lacked locus standi, relying on the so-called Plaumann-formula – case law from 1963 – to interpret Article 263 TFEU and the rules on standing. This formula has been heavily criticized in other contexts. In this context where the sufficiency of EU climate protection legislation is challenged, this criticism is particularly pressing as other judicial remedies are not able to serve the aim of the applicants. By applying the narrow Plaumann-formula to determine locus standi, the Court essentially shut the door close on the possibility of such climate litigation claims brought forward by private applicants. The article will outline the prospects – or rather the current lack – of locus standi of private applicants before the CJEU with a focus on the People’s Climate Case. Against this background, we will discuss new and existing criticism of the Court’s exceptionally narrow view on standing of private applicants, raising the question why the Court still applies the Plaumann-formula and why it expressly refuses to change its approach.
