Der Artikel befasst sich mit der Neuregelung der Ehemündigkeit durch das Gesetz gegen Kinderehen. Das Mindestalter für Eheschließung beträgt 18 Jahre. Die Möglichkeit der Befreiung durch das Familiengericht besteht nicht mehr. Eine Ehe, die ungeachtet dessen eingegangen wird, ist nichtig, wenn der Verlobte jünger als 16 Jahre ist. Sie muss gerichtlich aufgehoben werden, wenn der Verlobte bei Eheschließung bereits dieses Alter erreicht hat, jedoch noch nicht 18 Jahre alt ist. Hiervon gibt es nur wenige Ausnahmen. Die Neuregelung wird auf Eheschließungen erstreckt, die hinsichtlich der Voraussetzungen ausländischem Recht unterliegen. An Stelle des Heimatrechtes findet jedoch das deutsche Recht über die Ehemündigkeit Anwendung. Das trifft auch dann zu, wenn die Ehe im Ausland geschlossen wurde. Der Artikel analysiert die Neuregelung und zeigt die zahlreichen Schwachstellen auf. Einen Schwerpunkt bilden die Ehen von Flüchtlingen, die nach Deutschland gekommen sind.
