Verfassungsrechtliche Zulässigkeit eines verbindlichen letzten Kindergartenjahres zur Schulvorbereitung – anhand der beabsichtigten Einführung im Freistaat Sachsen

The question of whether a compulsory last year of nursery school is permissible under German constitutional law has been the subject of controversial debate in the literature to date. This article, which is based on a legal opinion for the State Ministry of Culture, examines the legal situation comprehensively for the first time with regard to the Free State of Saxony, which intends to introduce such an obligation in this legislative period. As the standards of the constitutional review are mainly derived from the Federal Constitution (Grundgesetz), the results of the study can also be largely transferred to other German states.
