Zurück in die 1950er Jahre. Die Abschaffung von affirmative action an Hochschulen durch den U.S. Supreme Court

The Trump administration’s January 2025 attack on diversity, equity and inclusion (DEI) programs was initiated and supported by a 2023 U.S. Supreme Court’s ruling (Students for Fair Admissions v. Harvard College). The ruling prohibited race-conscious admissions procedures at elite universities (such as Harvard) that gave people of color a bonus under affirmative action and pursued the goal of inclusion. To terminate affirmative action the verdict ruled out race-conscious admission policies of elite colleges and undermined inclusion as an educational goal. The article shows how the Equal Protection Clause itself and the restrictive interpretation of the majority of judges are thwarting efforts to achieve greater equality of opportunity for members of disadvantaged social minorities.
