The first part of the contribution on child related aspects of the Area of Freedom, Security and Justice was devoted to the evolution of a system of children´s rights protection at the level of primary EU law and to EU action in the field of Judicial Cooperation in Criminal Matters. The focus there was on the legal position of children as victims of criminal offences. The present second part of the contribution examines the legal position of children who themselves are suspects or accused persons in criminal proceedings and persons sought under the European Arrest Warrant. Among other questions, it considers the extent to which the specific situation of children is taken into account in proceedings for the execution of the European Arrest Warrant and whether, for reasons relating to the protection of the rights of the child, obligatory execution of a European Arrest Warrant may be declined.
