The FAIR and CARE principles – as well as other sets of principles – are increasingly gaining attention in research on and within the research data lifecycle. The recent mention of these principles in calls for proposals issued by the German Research Foundation (DFG) and the Federal Ministry of Education and Research suggests a closer examination. Against this background, the article identifies the (German) legal coordinates of the FAIR and CARE principles. The authors highlight existing legal regulations that allow to discern the principles, which inherently belong to an ethical research code of conduct. Moreover, legal obstacles to the implementation of the principles can be identified, which is why the conclusion both offers recommendations and highlights several critical aspects.
