Strukturwandel der rechtswissenschaftlichen Wissensproduktion – Rechtsempirische Analyse gerichtlicher Verweise auf Blogs in der Corona-Pandemie –

During the Corona pandemic, courts consulted and cited scholarly blogs to an unprecedented extent – this is the clear picture that emerges from a systematic evaluation of court decisions by German administrative and constitutional courts during the early days of the COVID-19 pandemic. Has the pandemic thus finally helped blogs to establish themselves as a scholarly format? This is the question we would like to explore in this paper. The research confirms that the special circumstances of the pandemic favored the new citation habits. The “fast format” blog, in which lines of argument were thought ahead, was better suited to an era characterized by fast pace and knowledge deficits than print publications. However, there is much to suggest that blogs will not lose the authority they have gained. At the same time, the numbers confirm that blogs might have adapted to a greater extent to the system of knowledge production rather than fundamentally changing it.
