The Data Governance Act does not impose additional obligations on research institutions as a general rule, as far as can be judged at present despite all the uncertainties of interpretation, since research institutions do not fall within the scope of either Chapter II or Chapter III when repositories make research data and publications available under free licenses for research. Research institutions are explicitly addressed only by the options created in Chapter IV for registering as a recognised data altruism organisation. However, it remains to be seen whether the regulatory concept behind data altruism will work out and whether the registration will actually be perceived as evidence of trustworthiness that increases the willingness to share data. Researchers who obtain data from public bodies can benefit from the single information points to be set up by Member States, the support to be provided by public bodies, and new structures such as secure processing environments. Limitations arise, however, with respect to third country transfers.
