Le droit au partage équitable des biens des époux : relecture du droit congolais de la famille à la lumière du Protocole de Maputo

The African Commission on Human and Peoples' Rights recently published a general comment interpreting article 7(d) of the so-called Maputo Protocol. According to this article, the woman has a “right to an equitable sharing of the joint property deriving from the marriage”. Despite the modification of the Congolese Family Code, this right is far from being effective as it may derive from the law and pertinent cases.
