The article explores the responses by certain States to the introduction and application of the National Security Law in Hong Kong in 2020, on the assumption that it breaches the Sino-British Joint Declaration and fundamental human rights of the population of Hong Kong. It examines the lawfulness of these responses and argues that some of them constitute retorsions, while others can be considered as instances of ‘collective’ countermeasures in response to the serious breach of erga omnes (partes) obligations by China.
