The decision from 2022, discussed in the article, has led to heated debates. It made and will continue to make abortions very difficult in several US-states. It also goes against a trend in most of the world’s countries to liberalise abortion policy. From a methodological point of view Dobbs v. Jackson relies heavily on historical arguments, an approach, which is questionable. Additionally, it overrules longstanding precedent, namely Roe v. Wade from 1973. The article focuses on the questions which conditions must be met for an overruling and whether they are sufficiently met in this case.
