Das 2022 Northern Ireland Protocol Bill: Chronik eines angekündigten EU/UK Handelskrieges?

Sechs Jahre nach der Brexit-Abstimmung und nun, nach Vorlage des 2022 Northern Ireland Protocol Bill (NI Protocol Bill) steht das Irische/Nordirische Protokoll (I/NI-Protokoll) wieder auf der Tagesordnung. Das NI Protocol Bill erinnert an frühere Versuche des Vereinigten Königreichs, sich von den Bedingungen der Austrittsregelungen zurückzuziehen und ist, so argumentiert London, wegen seiner „Notwendigkeit“ gerechtfertigt. Dieser Artikel kontextualisiert die Herangehensweise des Vereinigten Königreichs und bewertet die vorprogrammierten Konflikte dieses Ansatzes, u.a. mit dem EuGH, der EMRK und der WTO. Auf die Schlacht⁠feld⁠optionen im angekündigten Handelskrieg zwischen der EU und dem Vereinigten Königreich wird daher eingegangen: nuklear (Kündigung); strategisch (Teilaussetzung(en)); und konventionell (Gegenmaßnahmen und Vertragsverletzungsklagen). Ferner wird gefragt, ob Nordirland auf einen „europäischeren“ Kurs gebracht werden kann, welche Auswirkungen für Schottland drohen und ob ein Brexit, der so spektakulär misslungen ist, von einem künftigen englischen PM oder Parlament herangezogen werden kann, um die Londoner Beziehungen zur EU neu auszurichten.
